TAMIL NADU TIMBER TRANSIT RULES, 1968


DEFINITION

Explanation for act, schedule, timber which includes all except Prosopis juliflora, Casuarina equisetifolia, Subabul, Eucalyptus hybrid, Palmyra, Poovarasu, Erythrina indica, Acacia planifrons.


CONDITIONS OF TRANSIT OF TIMBER

No person shall move timber into or from or within the state by land, water or air unless such timber is accompanied by a permit prescribed therefore under rule 4.


FORM OF PERMITS
  • In timber from government lands, the Form I is need and fee is calculated at the rate of ten paise per form sale be charged
  • In timber from private lands, an application is supplied by the range officer @ 1.00 per form, no other permit shall be used
      • Permit may either be in English or Tamil language and all the permits should have serial number.
      • Permit II / Form II for timber from private lands
      • A way permit in Form III shall be granted in exchange for each permit in Form I or Form II at the first checking station on the route by which the timber passes and the form III is prepared with duplicate and one of the copy is given to the transporter for further use.
      • Form IV deals with property marks and granted by DFO on registration of property mark to the individual.
      • Form V is a particular of registration of property mark maintained in the office.
      • Form VI deals with particulars of materials (trees) in land.

ISSUES OF PERMITS
  • Form I in triplicate, partly filled up by DFO
  • Permits in Form II in triplicate and shall have all the parts filled up by the person disposing of the timber or his authorized agent
  • Return of the counterfoils of the permits, if any, already supplied
  • Permits issued in the serial order
  • Each cart or other vehicle carrying timber shall be covered by a separate permit in Form I and Form II
  • The permit in Form I and Form II shall not exceed a period of one month from the date of the issue of the permit

CHECK OF PERMITS
  • Time to time notified by the Collector in the District Gazette as a checking station
  • Any Police Officer in uniform not below the rank of Forest Guard or Tanahdar wherever there are tanahs may stop any vehicle
  • Signing by a vehicle driver with vehicle carrying timber in the Registrar maintained
  • Exchange of Form II to Form I by the Officer in charge called the way permit
  • Timber in transit produced between the hours of 6 AM and 6 PM.

SITUATION OF CHECKING STATION

Not made within the limits of municipalities and corporations, except:

  • In cases in which it is considered necessary to guard against smuggling from unreserved lands into towns or
  • In places which afford special facilities for the regulation of traffic, such as, the meeting of roads and waterways
  • No demand shall be made under these rules for the production of permit within the limits in municipalities and cooperation, except at the checking stations.

USE AND REGULATION OF PROPERTY MARKS

After the application for the removal of timber is received the Assistant Conservator of Forests or the Ranger concerned shall as soon as possible, inspect and if the timber stored qualified for issue of transport permit, affix the departmental hammer mark on the timber.


DATE UP TO WHICH THE REGISTRATION OR RENEWAL HAS EFFECT

This shall be valid only in respect of the description and quantity of the timber entered in Form IV and shall unless otherwise stated be in force until the first day of April immediately following such registration or renewal.


RED SANDERS WOOD

No person shall have in his possession or move red sanders timber chips or powder except under a special permit issued by the DFO in Form VI. Provided nothing in the rules shall apply to:

  • Red sanders wood not exceeding 5 kg, in weight carried by any bonafide traveler or any person authorities by him in writing for his personal use, or

  • In patta lands of the said ryot, a certificate is obtained from the village municif and that the quantity cut and carried does not exceed 5 kg in weight.
